Avoiding Pitfalls and potholes on the road to

disability and leave management

 

 

One of the biggest challenges for Human Resources professionals is the management of employee leaves of absences and disability accommodation requests.  The recent passage of the ADA Amendments Act poses an even greater hurdle – employees are provided with expanded rights and employers now have additional obligations.  These changes will likely result in an increase in administrative charges and lawsuits.  This seminar will provide practical advice to Human Resources professionals on how to comply with the ADA, the new FMLA regulations and the proposed Ohio maternity leave changes. 

 

 


Biography

Nicole Monachino is an associate in the Cleveland office of Jackson Lewis LLP.  Prior to working at Jackson Lewis, Ms. Monachino worked in the Labor and Employment practice group at McDonald Hopkins Co., LPA, a regional law firm with over 120 attorneys.  She is admitted to practice before the federal and state courts in Ohio, the United States Court of Appeals for the Sixth Circuit and federal courts in Indiana and Illinois.  Ms. Monachino received her juris doctorate degree, cum laude, from the University of Notre Dame Law School.  She received a Bachelor of Arts, summa cum laude, from Hiram College. 

Ms. Monachino has extensive litigation experience representing employers and managers in employment discrimination/harassment/retaliation claims, wage and hour lawsuits and restrictive covenant disputes.

Vincent J. Tersigni is a partner in the Cleveland office where he focuses exclusively on representing employers in both the public and private sectors in labor and employment law matters, including:  employment discrimination, non-competition litigation, wage and hour, unemployment compensation, civil rights, union negotiations, arbitrations, union elections, National Labor Relations Board (NLRB), and Occupational Safety & Health Administration (OSHA) matters. 

A significant part of his practice involves advising employers regarding compliance with state and federal employment laws, preventing employment-related disputes, whistleblower claims, and implementing effective personnel policies.  Mr. Tersigni is a frequent lecturer and author on labor and employment law topics including the Family and Medical Leave Act, the Americans with Disabilities Act, union avoidance, and drug testing.
